Terms and conditions

for the use of Kammzeit. Last updated: 2 November 2026

§ 1 Provider and scope

  1. The provider of Kammzeit is Ben Oliver Mallow, sole proprietor, also trading under the name InstantNode, Sickinger Straße 7, 55758 Sien, Germany, email kontakt@kammzeit.de ("we", "us").
  2. These terms and conditions apply to all contracts between us and the customer (the "salon") for the use of the online service Kammzeit at kammzeit.de and kammzeit.com and the associated booking pages (the "service").
  3. Deviating or supplementary terms and conditions of the salon do not apply, even if we do not expressly object to them. Individual agreements take precedence over these terms and conditions.

§ 2 Business customers only

  1. Kammzeit is intended exclusively for businesses within the meaning of § 14 BGB (German Civil Code), i.e. salons and other businesses that act in the exercise of their trade or self-employed professional activity when concluding the contract. We do not enter into contracts with consumers (§ 13 BGB).
  2. When registering, the salon confirms that it is acting as a business. We may ask for suitable proof, for example a business registration.

§ 3 Services

  1. Kammzeit is software for online appointment booking that we provide as a service over the internet. This includes in particular a public booking page for the salon at its own address (e.g. salonname.kammzeit.de), which the salon can design with a logo, links to social networks and opening hours, a dashboard with calendar, customer records, services, team and settings, which can also be installed as an app on a phone or computer, and automatic emails to the salon's customers (confirmation, reminder, cancellation link) and to the salon. Further functions are part of the Pro plan (§ 5(2)). The detailed scope follows from the description on kammzeit.de and kammzeit.com and from the selected plan (§ 5).
  2. Contracts for appointments and services of the salon are concluded exclusively between the salon and its customers. We are not a party to them, not the salon's representative and not responsible for the offer, prices, performance or cancellation of appointments. Kammzeit does not process payments from the salon's customers.
  3. We send emails to the salon's customers via our mail servers. Whether an email arrives also depends on the recipient's email provider (e.g. spam filters). We therefore cannot guarantee delivery.
  4. We provide support by email without guaranteed response times. We do not owe setup, consulting or integration with other systems.
  5. We continue to develop Kammzeit and may change the service insofar as this is reasonable for the salon, in particular if the core functions (booking page, calendar, customer records, confirmation and reminder emails) are retained. If we significantly restrict functions of the Pro plan, we will announce this by email at least six weeks in advance. The salon may then cancel the Pro plan with effect from the date of the change and will receive a pro rata refund of fees paid in advance for the period thereafter.

§ 4 Registration and conclusion of the contract

  1. To register, the salon enters its name, the desired address of the booking page and an email address on kammzeit.de or kammzeit.com, accepts these terms and conditions and the data processing agreement and confirms that it is a business. It can correct its entries at any time until it submits the form.
  2. By submitting the form, the salon makes an offer. The contract for the Free plan is concluded when we create the account and send the login link by email. There is no entitlement to the conclusion of a contract. We may reject a registration in particular if the desired address infringes the rights of third parties or is misleading.
  3. The contract for the Pro plan is concluded when the salon selects the Pro plan in the dashboard and completes the payment process at Stripe.
  4. The contract language is German. We do not store the contract text separately. These terms and conditions and the data processing agreement are available at any time at kammzeit.de/agb and kammzeit.de/avv and can be saved or printed. English translations for convenience are available at kammzeit.com/terms and kammzeit.com/dpa.

§ 5 Plans and prices

  1. Free: free of charge, with one active staff member. The booking page shows the note "Online-Termine mit Kammzeit" (on English booking pages, its English equivalent) with a link to the Kammzeit website.
  2. Pro: unlimited staff members, without the note. In addition, Pro includes:
    • staff logins: separate access to the dashboard for the salon's staff, with restricted rights (calendar, customer records, waiting list and their own working hours),
    • a waiting list for walk-in customers with QR code, status page, email notification and a display for a screen in the salon,
    • a cover image, design options (font, corners, light or dark, welcome text) and a photo gallery with up to 12 images on the booking page.
Price: €14.90 per month with monthly payment or €149 per year with annual payment.
  3. The prices are final prices. As a small business under § 19 UStG (German VAT Act), we do not charge VAT. If VAT becomes payable on our services in future, for example because the small business scheme no longer applies to us, it will be added to the prices stated. We will announce this by email at least six weeks in advance. The salon may then cancel the Pro plan with effect from the date of the change.
  4. Price changes only apply to future billing periods. We will announce them by email at least six weeks before the start of the billing period from which they are to apply. Until then, the salon may cancel the Pro plan with effect from the end of the current billing period. If it does not cancel, the new price applies from then on. We will point out this consequence in the announcement.

Note on VAT for salons outside Germany: We do not charge VAT (German small business scheme, § 19 UStG). For businesses in other EU countries the reverse charge procedure may apply. In that case the salon accounts for any VAT due in its own country. This note is for information only and does not change the prices.

§ 6 Payment via Stripe

  1. The Pro plan is paid for via the payment service provider Stripe Payments Europe, Ltd. (Ireland). The payment methods offered during checkout are available. In addition, the terms that Stripe specifies for the selected payment method apply to the payment (e.g. a SEPA direct debit mandate).
  2. The fee is due in advance at the start of each billing period (month or year) and is collected via Stripe.
  3. The salon receives invoices electronically by email or in Stripe's customer portal. The salon agrees to receive electronic invoices.
  4. If a payment fails, we will inform the salon by email. If the fee has still not been paid 14 days after this notice, we may downgrade the account to the Free plan. Further statutory rights in the event of late payment remain unaffected.

§ 7 Term and cancellation

  1. Free: The contract runs for an indefinite period. The salon can end it at any time by deleting its account in the dashboard or by giving us notice in text form (e.g. by email). We may terminate it with four weeks' notice in text form.
  2. Pro: The term corresponds to the selected billing period (one month or one year). It is renewed for the same period each time unless cancelled before it expires. The salon can cancel at any time with effect from the end of the current billing period, via the customer portal (in the dashboard under "Plan") or in text form. The Pro plan remains usable until the end of the period. We may terminate with one month's notice to the end of a billing period in text form.
  3. When the Pro plan ends, the account continues on the Free plan unless the salon deletes it. The limits of the Free plan then apply again: staff logins are paused (logging in is not possible and current sessions end), the waiting list is not available, and the booking page shows the standard design again without cover image and photo gallery. Nothing is deleted in the process: data, logins, settings and images remain stored and take effect again as soon as the salon books Pro again.
  4. The right of both parties to terminate without notice for good cause remains unaffected. For us, good cause exists in particular if the salon seriously or repeatedly breaches § 9 despite a warning. If we terminate for good cause for which the salon is not responsible, we will refund fees paid in advance on a pro rata basis.
  5. If the salon cancels with effect from the end of the billing period, fees already paid are not refunded.

§ 8 Availability and maintenance

  1. We operate Kammzeit with the care of a diligent provider and endeavour to keep it available with as few interruptions as possible. We do not promise any particular availability, for example as a percentage. The service may be temporarily unavailable, for example due to maintenance, disruptions beyond our control (internet, data centre) or attacks.
  2. Where possible, we schedule planned maintenance between 22:00 and 06:00 (German time). We announce planned maintenance that is expected to last longer than 30 minutes at least two days in advance by email or in the dashboard. We may carry out urgent maintenance, for example to close security vulnerabilities, at any time.
  3. The salon's statutory rights in the event of defects remain unaffected. The salon reports disruptions by email without undue delay.

§ 9 Obligations of the salon

  1. The salon provides truthful information when registering and keeps its email address up to date.
  2. Access: Logging in is only possible via a link sent to the email address on file. Anyone with access to this mailbox can log in. The salon therefore protects the mailbox like a password (strong password, two-factor authentication where possible), logs out on devices that are not its own and informs us without undue delay if it suspects misuse.
  3. Staff logins: The salon decides whom it gives a login and is responsible for the use of Kammzeit via these logins as for its own use. It only gives logins to people who work for its business and need the access for their work, obliges them to keep the data confidential and to protect their mailbox in accordance with paragraph 2, and removes a login in the dashboard without undue delay when the person leaves or no longer needs the access.
  4. Images: If the salon uploads images (logo, cover image, photo gallery), it must hold the necessary rights, for example the rights of use from the photographer or designer. It only uploads images in which people can be recognised, for example customers or staff, if these people have consented to publication. The salon obtains and documents this consent itself.
  5. Obligations towards its own customers: The salon is itself responsible for its booking page and for the processing of its customers' data. In particular, it provides its own imprint and its own privacy information under Art. 13 GDPR (Kammzeit offers a field for the link to the imprint), provides the information required by law, for example on prices, and obtains any necessary consent, for example if it records health information such as allergies in the customer records.
  6. Lawful use: The salon uses Kammzeit only for appointments of its own business. It does not post any unlawful content or content that infringes the rights of others, does not use the email functions for advertising or spam, does not attack the service, does not query it automatically to an extent that impairs operation, and does not circumvent the limits of the plans, for example by using several Free accounts for the same business.
  7. The salon indemnifies us against third-party claims based on unlawful content of the salon (for example images without the necessary rights or consent) or on unlawful use for which the salon is responsible, including use via its staff logins. This includes reasonable costs of legal defence.
  8. We recommend that the salon regularly backs up its data using the export function.

§ 10 Illegal content and blocking

  1. Notices of illegal content on a booking page can be sent to kontakt@kammzeit.de. This address is also our point of contact for authorities and users under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act); languages: German and English.
  2. If there are specific indications of illegal content or misuse of the service (e.g. spam, phishing, infringement of third-party rights), or if an authority requires it, we may block individual content or all or part of the booking page. We choose the least severe suitable measure, inform the salon with a statement of reasons and give it an opportunity to comment beforehand unless there is imminent danger. We lift the block as soon as the reason for it no longer applies.

§ 11 Data and processing on behalf of the salon

  1. We process the data of the salon's customers, of people on its waiting list and of its staff, including staff logins, as well as images showing people, on its behalf. This is governed by the data processing agreement (DPA), which the salon concludes with us when registering and which forms part of this contract. In matters of data protection, the DPA takes precedence over these terms and conditions.
  2. The data belongs to the salon. We use it only to provide the service. We do not sell it, do not pass it on for advertising and do not use it to train AI models.
  3. The salon grants us the simple (non-exclusive) rights to its content (e.g. texts, service descriptions, name, logo and photos) that we need to operate the service, for example to store it, adapt it technically (for example to resize and re-save images), display it on the booking page and in the dashboard and use it in emails. These rights end with the contract.
  4. Our privacy policy applies to data that we process as an independent controller (e.g. account and billing data).

§ 12 Data export and deletion

  1. During the term, the salon can export its data at any time in the dashboard in a common, machine-readable format. Uploaded images are listed in the export with their address and can be downloaded from there.
  2. The salon can delete its account at any time in the dashboard; the contract then ends with immediate effect. If a Pro plan is running, it must first be cancelled via the customer portal; the account can be deleted once the plan has expired at the end of the paid period.
  3. If the contract ends in any other way, the salon can export its data until the end of the contract. After that, we delete it. The data disappears from our backups no later than 30 days after deletion. If the salon wishes to keep data for longer, it must export it beforehand.
  4. We retain invoice and payment data for as long as the law requires.

§ 13 Liability

  1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (Produkthaftungsgesetz) and insofar as we have given a guarantee.
  2. In the case of slight negligence, we are only liable if we breach an essential contractual obligation. Essential obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment the salon may regularly rely, for example providing the booking page and storing the data securely. In this case, liability is limited to the damage that is typical for the contract and foreseeable at the time the contract was concluded.
  3. We provide the Free plan free of charge. By way of derogation from paragraph 2, we are liable for it only in the cases set out in paragraph 1.
  4. Strict liability (regardless of fault) for defects that already existed when the contract was concluded (§ 536a(1), first alternative, BGB) is excluded.
  5. These rules also apply to the personal liability of the persons we use to perform our obligations. Liability towards data subjects under Art. 82 GDPR remains unaffected.

§ 14 Open source

  1. The Kammzeit software is licensed under the GNU Affero General Public License, version 3 (AGPL-3.0). Rights to the software itself are governed solely by this licence.
  2. These terms and conditions only govern the use of the service we operate at kammzeit.de and kammzeit.com. They do not restrict the rights under the AGPL-3.0. These terms and conditions do not apply to installations that someone operates themselves.

§ 15 Changes to these terms and conditions

  1. We may amend these terms and conditions with effect for the future if there is an objective reason for doing so, such as a change in the law, in case law or in the service. We do not change main obligations and prices in this way; § 3(5) and § 5(3) and (4) apply to those.
  2. We will announce changes by email at least six weeks before they take effect and send the new version with the announcement.
  3. The salon may object to the changes in text form until they take effect. If it does not object, the changes are deemed accepted. We will expressly point out this consequence, the deadline and the right to object in the announcement.
  4. If the salon objects, the contract continues on the previous terms. Either party may then terminate it with effect from the end of the current billing period, or, in the case of the Free plan, with four weeks' notice.

§ 16 Final provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. If the salon is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is our place of business. Mandatory statutory places of jurisdiction remain unaffected.
  3. Declarations relating to the contract may be made in text form (e.g. by email), unless these terms and conditions provide otherwise.
  4. If any provision of these terms and conditions is invalid, the rest of the contract remains valid. The statutory provisions take the place of the invalid provision.
